Here are a few tips on writing EDD appeal form – this is what you need to complete on the form.
Tip One- Fill Out the Application Completely
You should complete the general information about yourself, like your name, home address, telephone number and your Social Security number. Make sure that you fill out everything out completely.
You should already know why you are completing an appeal form prior to even filling it out. This section of the form is crucial because it requires that you divulge all of the details as to why you need to appeal the decision (that is if you are facing a level one appeal).
If you are completing a level two appeal then you need to state why you would like for the Administrative Law Judge’s Decision to be reviewed.
Be careful of your word choice and be sure to have a keen eye for detail. Everything that you write in this particular section can be subject to scrutiny. So write it as professionally as possible.
The initial decision made by EDD is the sole reason why you would need to submit an appeal form. You should include a copy of the decision letter that was sent to you either from EDD or from the administrative law judge. In the reason for your appeal you should definitely cite a passage from this decision letter.
Prior to submitting your appeal, you should be very familiar with the Unemployment Insurance Code. It is this reference information that the Appeals board uses in order to arrive at their final decision for either a first or second level appeal.
Take the time out to read everything in the Unemployment Insurance Code. You may find that many of the grounds for rejecting an appeal are listed in there.
The Benefit Determination Guides and Precedent Benefit Decisions are also reference materials that are used to determine the decision for your appeal as well. These materials are available on the EDD website for you to review.
Be sure to look closely for information on how an appeal decision is determined. Once you have reviewed the information in these guides then you can go back and take a closer look at your appeal form prior to submitting the form to the Appeals Board of the EDD.
